General Conditions for Supply – Stakeholders’ personal data protection
The Centre for the Professional Training of the Textile, Apparel, Clothing and Wool Industry, herein referred to as MODATEX is committed to scrupulous compliance with legal regulations on secrecy, confidentiality and protection of the personal data of the stakeholders with whom they do business. Convinced of the importance of protecting Personal Data, we value and favour third parties who also act according to high principles of rigour and professionalism, ensuring the primacy of the interests of all parties at all times.
Personal Data are any information, of any nature and regardless of its support, related to an identified or identifiable natural person (Data Subject).
MODATEX is responsible for the treatment of data and it can be contacted by postal address at Rua Professor Augusto 483, 4150-119 Porto or, alternatively, by email at DPO.mx@modatex.pt.
The Data Protection Officer (DPO) can be contacted at MODATEX’s postal address or, alternatively, by email at DPO.mx@modatex.pt and is bound to secrecy or confidentiality in the exercise of his or her functions, in accordance with Union or Member State law.
MODATEX applies appropriate technical and organisational measures to ensure a level of security appropriate to the risk, by keeping Personal Data on file and during its transmission.
MODATEX has a computer system capable of resisting, with a given level of confidence, accidental events or malicious or illicit actions that compromise the availability, authenticity, integrity and confidentiality of the Personal Data stored or transmitted, as well as the security of the related services offered by or accessible through these networks and systems.
Without prejudice to legal or regulatory provisions to the contrary, Personal Data will only be kept for the minimum period necessary for the purposes that motivated their collection or their subsequent processing after which they are eliminated or, if it is of MODATEX’s interest, processed for statistical purposes, anonymized, so that it is not possible to identify their Owner.
Although the information provided is generally treated as private at MODATEX, the data collected will be used in compliance with the General Regulation on the Protection of Personal Data throughout the treatment process; however, it may be necessary to transfer Personal Data privately to other bodies, in particular the judiciary, and in processing your request we may send your data to, and also use information from credit and fraud prevention agencies.
The data collected and recorded may be communicated to the various Local Units of MODATEX or to external entities in partnership with or representing MODATEX, established within or outside the European Union, in compliance with the duty of confidentiality and the principle of purpose provided for above. Transfers to third countries need adequate safeguards where that country does not have an adequate level of protection.
Subcontracted entities, as well as entities that provide or license services to MODATEX, including those based outside the European Union, may have access to data collected and recorded by MODATEX when and to the extent that that is necessary for the supply of products or services within the scope of the activity developed by MODATEX, or for the fulfilment of contractual obligations established between MODATEX and the interested parties with which it is related.
We also share data when required by law or to respond to legal processes; to protect our clients; to protect lives; to maintain the safety of our services; and to protect MODATEX’s rights and property
Even though information is treated as private and confidential at MODATEX, the information collected may also be passed on to MODATEX’s lawyers when it deems necessary to defend the legitimate interests of the organisation.
Consent is required for the further processing of Personal Data for a purpose other than that for which the data was collected. Prior to such processing, MODATEX provides the information about this purpose and any other relevant information.
You have the right to file a complaint with a European Union supervisory authority regarding the protection of your Personal Data. MODATEX will co-operate with the Supervisory Authority by providing all the information that it may request in the exercise of its competences.
Data collected and processed under this contract are intended for the management of the relationship between the interested parties and MODATEX or others, for external entities in partnership with or representing MODATEX. The data collected may also be processed for statistical purposes and for promotional and marketing activities, namely to promote new training sessions, events and services or projects by e-mail, SMS, MMS or any other electronic communications service when authorised by the Data Owner.
The management of the contractual relationship does not make comparisons, interconnections or any other form of interconnecting registered information or automated decision making, including profiling in relation to Personal Data.
By providing information, the customer gives their informed and unequivocal consent to the automated processing of their data.
The recipients or categories of recipients of your Personal Data are the various Organic Units of MODATEX.
We rely on the stakeholder to provide accurate and complete information and to update data whenever there are any changes in the information provided.
The interested party has the right to withdraw their consent for the processing of personal data concerning them at any time, without undermining the lawfulness of the processing based on the consent previously given. You can also ask MODATEX access to your Personal Data, its correction or deletion as well as the limitation of all information that concerns the owner of the data. You can also object to the processing and exercise the right to data portability. The aforementioned rights can be exercised by means of written communication addressed to MODATEX.
The Personal Data necessary for the execution of the contract in which the User is a party, for the fulfilment of the legal obligations to which the Person Responsible for the Treatment is subject and those that are necessary for the effect of the legitimate interests pursued by MODATEX are not included in the previous point.
If the User’s requests are manifestly unfounded or excessive, especially due to their repetitive nature, under the legal framework in force MODATEX may demand the payment of a reasonable fee to cover the administrative costs of providing the information or communication, or of taking the requested measures, or it may refuse to comply with the request.
MODATEX ensures that those authorised to process the Personal Data of the interested party are bound by confidentiality or are subject to appropriate legal obligations of confidentiality.
